This action was commenced against Catherine Van Keuren (hereinafter decedent) and defendant to foreclose a mortgage in the original sum of $100,000 given to secure a loan for the purchase of real property located in the Towns of Andes and Middletown, Delaware County. Prior to the entry of the judgment of foreclosure and sale, a separate, unrelated action between plaintiff and defendant was settled by a stipulation.
