Decision and Order Re: (1) Debtor’s Objection to the Claim No. 2 Filed by Madeline Dempster; and (2) Motion by Madeline Dempster to Vacate the Stay
DOROTHY EISENBERG, Bankruptcy Judge.
The Debtor has objected to the claim no. 2 by Madeline Dempster (“Claimant”) and seeks to expunge such claim on the grounds that Claimant is not a creditor of this Debtor’s estate. The Court agrees based upon the following findings of fact and conclusions of law in compliance with F.R.B.P. Rule 7052. In addition, the Court hereby vacates the stay to permit Claimant to have her rights adjudicated in State Court.
