The State’s attorney of Cook county presented to one of the judges of the circuit court an information in the nature of quo zmrranto against the Union Consolidated Elevated Railway Company, together with a petition for leave to file the same. Leave was granted and the information filed. Afterwards respondent filed a motion to set aside the order granting leave to file the information and •to strike the information from the files and abate the proceedings.
