Azar, II, Secretary of Health and Human Services, (collectively, the Secretary), appeal the district court's 1 partial grant of summary judgment for Children's Health Care 2 and Gillette Children's Specialty Healthcare (collectively, Children's Hospitals). The Secretary also challenges the district court's decision to vacate a Medicaid policy-Frequently Asked Question 33-which explained how to calculate a hospital's uncompensated medical care costs. We affirm.
