Gregory M. Weaver brought suit against ABC Bus, Inc., alleging that he was damaged when he was fraudulently induced to enter into an agreement for the lease of a used bus. The trial court granted summary judgment in favor of ABC, and Weaver appeals.

Appellant contends the trial court erred by granting summary judgment in favor of appellee because issues of fact remain regarding whether appellant properly rescinded the transaction and if so, whether appellant acted promptly after discovery of the fraud.
