Irene Brown has sued the State of Wisconsin and the Department of Revenue (DOR) for misrepresentation, breach of contract and declaratory judgment arising out of her purchase of a Wisconsin's Very Own Megabucks (WVOM) winning ticket. The trial court granted the defendants' motion to dismiss, concluding the State has not consented to suit on the misrepresentation claim; specific performance of a contract is not available against the State; and the declaratory relief sought was related to the contract claim.
