Appeal from the District Court of Hays. Tried below before Hon. L. W. Moore. Appeal from a conviction of murder in the second degree; penalty, six years imprisonment in the penitentiary. Appellant was charged by the indictment with the murder of C. H. Haney, on the 10th day of December, 1901, by striking him with a piece of iron piping. The .opinion states the essential facts attendant upon the killing.

BROOKS, Judge.

Appellant was indicted for murder, convicted of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of six years. The following are substantially the facts proven upon the trial: Dr. Beall testified that about 8 o’clock on the morning after deceased received the injuries from which he died, he was called to see him, and found two wounds upon his head; one was a scalp wound on the left side of the head about one and one-half inches long, along or over the parietal bone.
