OPINION AND ORDER

JAMES E. DOYLE, District Judge.

This action for personal injuries and wrongful death was commenced in state court and removed to this court on the basis of diversity of citizenship. It arises from an automobile-truck collision in Dane County, Wisconsin, on September 18, 1968.

From the 'uncontroverted allegations of the pleadings and affidavits herein, I find that Russell Korth, the plaintiff, is a resident of Illinois; that Korth was the driver of and his wife Corrine a passenger in the automobile involved in said collision; that Korth brings this action on his own behalf and…
