This is an appeal by the Warden of Clinton Prison from an order of the Clinton County Court, directing the Prison Board of Clinton Prison to certify relator’s name to the Governor in accordance with the provisions of the Correction Law.

The sole question involved here is whether or not upon a subsequent conviction the Parole Board may require a prisoner to serve the time he was without the prison walls on parole from his first sentence. Sormberger was first convicted March 2, 1923, for robbery in the first degree and sentenced for an indeterminate term of ten to fifteen years. He commenced his…
