The claims of the plaintiff arise from different sources and transactions, and they must be separately considered.
*219He first claims to recover the amount of a promissory note, made on July 20, 1837, payable to the town for $110,67. It was paid by the plaintiff to the town treasurer, on June 27, 1838.
