The plaintiff, Conrad Rechsteiner, III (“Rechsteiner”), has filed this action under the provisions of the Age Discrimination in Employment Act of 1967 (“ADEA”), 29 U.S.C. §§ 621 et seq. and the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001 et seq. Presently before the Court are several motions submitted by the defendant, Madison Fund, *501Inc. (“Madison Fund”), pursuant to Rule 12 of the Federal Rules of Civil Procedure.1
