DECISION ON MOTION FOR SUMMARY JUDGMENT

The trustee of Euro-Swiss International Corp. (“Euro-Swiss”), a Chapter 7 debtor in a bankruptcy case pending in this district, seeks to impress a constructive trust upon funds in a bank account maintained by Martin Fein & Co., Inc. (“Martin Fein”), a Chapter 7 debtor in this court, who conducted a sale as auctioneer for the Euro-Swiss trustee and did not remit or account for the net proceeds of that sale.
