Affirming.

On July 28, 1930,-appellant issued and delivered to appellee a fire insurance policy insuring certain household goods and furniture against loss by fire to a total amount of $1,000. Tbe property insured was partially destroyed by fire on February 11, 1931.

Tbis action was instituted to recover tbe full amount of tbe policy and on tbe trial of tbe case tbe jury returned a verdict for tbe amount claimed, and, from tbe judgment entered tbereon, tbe company appeals.

Tbe policy contains a clause which provides that'no suit tbereon shall be maintained until…
