This is an appeal by the plaintiff from a judgment rendered in favor of the defendant, and from an or der overruling a motion for a'new trial. The action is one in the nature of a creditors’ bill brought by the plaintiff, as a trustee in bankruptcy of the estate of John 0. Haines, bank rupt, against the said bankrupt and John 0. Haines, a corpor-*515afcion.
