Appellant charged in his libel that respondent deserted him in February, 1935, and persisted in the desertion until October 28, 1943, when this action in divorce was instituted. On a hearing before the trial judge, sitting without a jury, the libel was dismissed. Our own independent examination of the record has failed to convince us that the court erred.
About many features of the case there is little dispute. The parties were married June 18, 1927, when each was sixteen years of age, and they went to the home of respondent’s parents, where they lived for about a year…
