GAJARSA, Circuit Judge.

Petitioner Alfred Fusi (“Fusi”) appeals from the United States District Court for the District of Massachusetts’ denial of his petition for a writ of habeas corpus and request for an evidentiary hearing. See Fusi v. O’Brien, 588 F.Supp.2d 158 (D.Mass.2008). In his habeas petition, Fusi alleged that he was denied his Sixth Amendment right to effective assistance of counsel because his trial counsel failed to prepare for trial.
