The plaintiff instituted an action against the defendant on two promissory notes, one bearing date December 1, 1866, the other, April 29, 1874. Each note "bears interest from date at the rate of ten per cent, per .annum, and contains a clause, that if the interest is not paid annually it shall become principal, and bear the same rate of interest. The petition states that the notes Are entitled to. a number of credits, reciting them, and that the balance over and above such credits remains unpaid. The action was brought February 5, 1883.
