The Director of the Missouri Department of Revenue (“Director”) suspended the driver’s license of Justin Ray Hilkem-eyer (“Driver”) pursuant to § 302.505 after Director determined that Driver was arrested upon probable cause to believe he was driving while intoxicated, a violation of *63§ 577.010, RSMo 2000.1 Driver filed a petition for trial de novo in the circuit court pursuant to § 302.535.
