MEMORANDUM DECISION AND ORDER

ROBERT L. BERRY, Bankruptcy Judge.

By this adversary proceeding plaintiff, Carey Lumber Company (hereinafter “Carey”), seeks to: 1) deny, pursuant to 11 U.S.C. § 727, the discharge to the debtor; and 2) determine a debt to be nondischargeable pursuant to 11 U.S.C. § 523. Before the Court is Carey’s motion for summary judgment pursuant to Rule 7056 Fed.R. Bankr.P. and Rule 56 Fed.R.Civ.P., that there exists no genuine issue of material fact and that it is entitled to prevail as a matter of law.
