Key Risk Insurance Company (“insurer”) appeals from a decision of the Virginia Workers’ Compensation Commission (“commission”) awarding compensation benefits to Josephine H. Crews (“claimant”), the sole dependent of James E. Crews (“decedent”), who died in a work-related accident. Insurer asserts the commission erred in awarding claimant compensation calculated at the minimum weekly wage rate of $223.75, arguing there was no evidence before the commission that decedent earned any wages in the fifty-two weeks preceding his death.
