Appellant, a longshoreman, brought suit against appellee, a shipowner, under the diversity statute, 28 U.S.C., section 1332. More specifically, plaintiff sought damages for injuries he received on February 17, 1975, during the course of his employment in loading cargo aboard the vessel FINN-SAILOR at Newport News, Virginia. He alleged negligence on the part of the shipowner under the provisions of the Longshoremen’s and Harbor Workers’ Compensation Act, as amended in 1972, 33 U.S.C., section 901, et seq.
