* Writ of error granted May 27, 1925. The W. E. Callahan Construction Company entered into a contract with the Wichita County water improvement district No. 1 to construct certain irrigation ditches in Wichita and Archer counties. Thereafter the construction company sublet to W. E. Cecil the construction of three miles of such ditches; the work to be done by Cecil being the same as shown in the original contract as "schedule 3" and embracing "Southside Canals."
