— This was a suit by the appellee against the appellant, in a complaint of two paragraphs. The object of the suit was to recover damages for certain described injuries to a house and lot, owned by appellee, within the corporate limits of the city of Anderson. It was alleged that the injuries and grievances complained of were caused by the appellant’s negligent and unskilful construction of a certain ditch or drain, in such manner as to throw a large quantity of surface water on the appellee’s premises, and by its subsequent negligence in permitting such ditch or drain to become so obstructed…
