¶20 (dissenting) — Ronald Hall was sentenced to 30 years in prison for his vicious assault on Ms. Kim Krapf more than 10 years ago. Today, a majority of this court decides, in essence, that Hall should be set free after serving only 11 years for this crime.9 In light of a later United States Supreme Court decision, the trial court had erred in failing to submit the aggravating factors supporting Hall’s exceptional sentence to the jury.
