Appellee, Mrs. E. G-. Smith, filed suit in the chancery court for the eastern district of Lawrence county to partition eighty acres of land described as the N% of the NE14 of section 16, tp. 16 north, range 1 west, in which she claimed to be the owner of an undivided three-fourths interest and that appellant, Ottice Wells, is the owner of an undivided one-fourth interest.'
