Appeal from a judgment of the County Court of Schenectady County, rendered November 30, 1977, convicting defendant upon his plea of guilty of the crimes of robbery in the first degree, robbery in the second degree and escape in the first degree. In the early morning hours of March 19, 1976, a 91-year-old man, named Frank Ross, was beaten and robbed in his Schenectady home by three males. Defendant was charged by the Grand Jury with participation in this incident in a six-count indictment and, while incarcerated in the county jail, he escaped on October 13, 1976.
