Appeal by the defendants, George Archer and another, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of Rock-land on the 20th day of October, 1913, upon the decision of the court after a trial at the Rockland Special Term.

Burr, J.:

Michael A. Archer died August 23, 1881. He left him surviving his widow, Clarissa A. Archer, and three sons, Charles D. Archer, Allison M. Archer, and the above-named defendant, George Archer. He left a last will and testament, which, on October 12, 1881, was duly admitted to probate in Rockland county. It contained these, among other provisions: “I give, devise and bequeath all my property, real and personal to my executors hereinafter named in trust to receive the rents, issues and profits thereof for and during the lifetime of my wife Clarissa A.
