In an action, inter alia, for a judgment declaring that Local City Ordinance 21-2007 of the City of New Rochelle is unconstitutional and in violation of state law, the plaintiffs appeal, as limited by their brief, from so much of an order and judgment (one paper) of the Supreme Court, Westchester County (Dono*534van, J.), dated September 10, 2007, as denied those branches of their motion which were to compel certain discovery and, sua sponte, dismissed the complaint for failure to state a cause of action.
