An indictment was found in the criminal court of Cook county against plaintiffs in error, Peter Swarkowski and Walter Mutarcyk, charging that on September 9, 1921, they “feloniously, burglariously, willfully, maliciously and forcibly did break and enter a certain building, to-wit, garage, of Stanley Wierbinski there situate, with intent the personal goods, chattels, money and property of Stanley Wierbinski in the said certain building, to-wit, garage, then and there being, then and there feloniously and burglariously to steal, take and carry away, and one motor vehicle, to-wit, an automobile…
