BEAM, JUSTICE, FOR THE COURT:
¶1. The motion for rehearing filed by First Bank is denied. The previous opinions are withdrawn, and these opinions are substituted therefor.
¶2. This appeal stems from a breach-of-contract and tort case in the Pike County Circuit Court. John and Cindy Henderson filed suit against Copper Ridge Homes ("Copper Ridge") and First Bank regarding the construction of their new home in Magnolia, Mississippi.
