In an action pursuant to article 15 of the Real Property Actions and Proceedings Law to compel the determination of certain claims to real property, defendants Carew appeal from an order of the Supreme Court, Nassau County, dated January 21, 1969, which granted plaintiff’s motion for summary judgment (CPLR 3212) as against them, including dismissal of their counterclaim and striking of their answer.
