This action is brought to recover upon a policy of insurance issued by the defendant, Metropolitan Life Insurance Company, upon the life of Cyril Keck. The plaintiffs, Christ Keck and Margaret Keck, were named as beneficiaries. The policy was issued February 4, 1931. The insured died November 13,1931.
The company defends upon the ground that the policy is void because of the untruth of a statement of a material fact made by the insured when he said in his application for insurance that he had not been attended by a physician during the past five years.
