CAVANAH, District Judge.

The United States brings this action under an act of Congress granting jurisdiction to the federal courts to procure a declaratory judgment, and asserting that an actual controversy has arisen between it and the defendants as to the validity of an easement and right of way over and across lands of the defendant Fuller for the con struction of a canal by the government for the irrigation of the Payette division of the Boise project — Black Canyon District.
