At the fall term of the circuit court of Bullock county, in this State, in the year 1868, Moses Perry, alias Powell, afreedman, was indicted for the murder of Alfred Perry. The cause came on to be heard and tried on the first day of December, 1868, when the following sentence and judgment was rendered against him, to-wit ':
