Appeal from the District Court of Gonzales. Tried below before the Hon. E. Lewis. In the opinion of this court will be found, not only the matters relevant to the rulings made, but also a clear statement of the material evidence on which the jury convicted the appellant of murder in the first degree. The defendant was indicted on February 10, 1873, in the District Court of Gonzales County, for the murder of Thomas Haldeman. The case was continued at the first term of the court, on the application of the defendant. It was tried at the October term, 1877, of said court, when the jury returned the following verdict: “ We, the jury, find the defendant guilty of murder in the *619first degree, as charged in the indictmentand the case is now before this court on appeal.
