This is an appeal from a judgment of the United States Customs Court, Third Division.
The collector at the port of New York assessed merchandise, consisting of salmon imported in tin containers, with an additional duty of 10 per centum ad valorem under the provisions of subdivisions (a) and (b) of section 304, Tariff Act of 1930, for the alleged reason that it was not “marked, stamped, branded, or labeled” so as to indicate the country of origin, and, acting under the authority conferred by the *212provisions of subdivision (c) of that section, withheld delivery of the merchandise and required…
