This action is brought pursuant to section 1638 of the Code of Civil Procedure to compel the determination of a claim to real property. The object of the action is to procure a judgment declaring illegal and void the liens for certain unpaid taxes and assessments appearing against plaintiff’s real property upon the records of the city of New Rochelle; and the ground of illegality is claimed to be that the property is insufficiently described on the assessment rolls upon which said assessments are based.
