Consolidated for purposes of hearing and trial respectively, Cause No. 61,706 is an appeal from an order revoking probation granted after a conviction for the offense of burglary with intent to commit rape—assessing punishment at six years confinement in the Texas Department of Corrections and imposing sentence accordingly, and Cause No. 61,707 is an appeal from a judgment of conviction for the offense of “criminal trespass of a habitation”1 in which punishment was assessed at confinement for one year in the Dallas County Jail and a fine in the amount of one thousand…
