Defendant, by information, was charged with having committed the crime of murder in the first degree, alleged to have been committed in Dawson county on the 3rd day of July, 1946, by “willfully, unlawfully, feloniously, premeditatedly and with premeditated malice aforethought” killing and murdering Frank Cavanagh. At the time of arraignment the defendant entered a plea of not guilty. Thereafter defendant and his counsel appeared in court and requested permission to withdraw his plea of- not guilty and to enter a plea of guilty.
