This is an action of trespass • to try title brought by appellant against Mrs. Sarah Mary Elizabeth Colley and her husband, Thomas M. Colley, to recover an undivided one-half interest in the W. N. Cox lea'gue of land in Hardin county.
The defendants answered by plea of not guilty and pleas of limitation of three, five, and ten years, and further specially pleaded, in substance, that if plaintiff ever had any cause of action against defendants for any portion of the land in controversy, “such cause of action was for a repartition of the estate of Thomas J. Word, deceased, and of his deceased…
