Counsel for .plaintiff and the defendant seem to agree, in stating the case in their respective briefs, that this suit is one to set aside and have annulled a referendum local option election 'held for Ward 5 of Rich-land Parish on May 23, 1950. That statement is in accord with the prayer of the petition of'the plaintiffs which is for “judgment decreeing the election held on May 23, 1950, to determine whether or not alcoholic beverages should be sold in Ward 5, Rich-land Parish, Louisiana, in accordance with the three propositions set forth in this petition, to be null, void…
