This is an action in which the appellant •bank claims the right to the possession of certain personal property for the purpose of foreclosing a chattel mortgage thereon.

The facts presented to the trial court are undisputed, and are shown by the record to be as follows: During the year 1920 John Hermann was -declared, by the co-unty court of Mellette county, to *130be an incompetent, and E.
