MORRISON, Judge.

The offense is the sale of marijuana; the punishment, ten years.

Officer Brannon testified that on the day in question, while dressed in plain clothes, he went to a shoe shine stand and inquired of the appellant if one Avola had been there and that appellant replied that Avola would be there in a short while. The witness stated that he took a seat; that the appellant shined his shoes; that he asked the appellant if he handled any “stuff” and that appellant replied that he had none but did have some “weed.” The officer stated that he told the appellant he would take three…
