Plaintiff Hornell Brewing Co., Inc. (Hornell), a supplier and marketer of alcoholic and nonalcoholic beverages, including the popular iced tea drink "Arizona”, commenced this action for a declaratory judgment that any rights of defendants Stephen A. Spry and Arizona Tea Products Ltd. to distribute Hornell’s beverages in Canada have been duly terminated, that defendants have no further rights with respect to these products, including no right to market and distribute them, and that any such rights previously transferred to defendants have reverted to…
