Appeal from Tompkins County Court. Action by Osc.ar Hagin, by George D. Hagin, his guardian ad litem, against the Cayauga Lake Cement Company. From an order striking out defendant’s counterclaim, and transferring the case from the trial calendar of the county court to the law calendar, defendant appeals. Reversed.
