This is an appeal from a judgment of the circuit court of Yazoo county awarding the appellee damages in the stun of ten thousand dollars for personal injuries alleged to have been sustained by the appellee as the result of falling into an unguarded excavation in a sidewalk of said city, the appellant herein.

The original declaration filed by the appellee averred that on February 8, 1926, a private party dug a ditch across the sidewalk on F'ilmore street in said city for the purpose of making a sewerage connection with the resi deuce of an abutting property owner; that the ditch was dug in the…
