MEMORANDUM OPINION AND ORDER

CHAMBERS, District Judge.

Phillip A. Ward (“Petitioner”) filed an application in this Court for a writ of habeas corpus. See 28 U.S.C. § 2254 (1996). Petitioner was convicted of first degree murder and aggravated robbery after a two day jury trial before the Honorable Daniel O’Hanlon in the Circuit Court of Cabell County, West Virginia. 1 Petitioner’s conviction was affirmed on appeal by the West Virginia Supreme Court of Appeals.
