Action in the district court for St. Louis county by the guardian ad litem of Emil Aho to recover $2,500 for personal injuries received by the minor while in defendant’s employ. The defense was contributory negligence on the part of plaintiff and that he voluntarily assumed the risk. The reply was a general denial. The case was tried before Ensign, J., and a jury which returned a verdict in favor of plaintiff for $950. Erom an order denying its alternative motion for judgment notwithstanding the verdict or for a new trial, defendant appealed.

The facts are as follows: Defendant, a corporation, owns and operates an underground iron ore mine, in and about which it employs a large number of men, and all necessary machinery and instrumentalities for taking and removing the ore from the mine.
