Appeals (1) from an order of the Supreme Court (Ferradino, J.), entered December 23, 2002 in Albany County, which, inter alia, granted defendant’s motion for restitution, and (2) from the judgment entered thereon.
Plaintiff contends in the current appeal that Supreme Court erred in denying him a default judgment against defendant and in directing him to pay restitution of the amount he had collected under a prior default judgment that had been vacated.
