This is an appeal from a judgment in favor of Sanders County, Montana, upon a jury verdict in the Fourth Judicial District, Sanders County, arising out of a train-vehicle collision in which the plaintiff, Harold Wollaston, was injured.

The collision occurred on January 19, 1974, at a grade crossing approximately one mile east of Thompson Falls, Montana. The plaintiff, Harold Wollaston, was operating a 1967 Pontiac in a northerly direction on the high school road which crosses over the Burlington Northern tracks.
